Detrekői on the EU Copyright Directive
With the amendment of two major directives, the Audiovisual Media Services Directive and the Copyright Directive, the European Union failed to duly examine the practical execution and possible effects of these provisions on services covered by the two directives and adopted provisions on liability that are in disaccord with each other, our Fellow, Zsuzsa Detrekői writes in her article published in Communications Law, peer reviewed, quarterly journal covering the broad spectrum of legal issues arising in the telecoms, IT and media industries (available in print only).
The article analyses “how Article 17 of the Copyright Directive will influence the operation of video-sharing websites and what major practical problems related to the article’s implementation have arisen given the fact that Article 17 dismisses limitation of secondary liability for user generated content and makes service providers directly liable for the acts of users, the operation of video video-sharing sites will drastically change.“
The article is an empirical analysis of the possible outcomes of implementation.
